New supplements regarding compulsory Social Insurance from September 1st,2021

Circular 06/2021/TT-BLDTBXH amending and supplementing a number of articles of Circular 59/2015/TT-BLDTBXH dated December 29th, 2015 of the Minister of Labor, War Invalids and Social Affairs, detailing and guiding the implementation of a number of articles of the Law on Social Insurance regarding compulsory social insurance, takes effect from September 1st, 2021.

Accordingly, the new points about compulsory social insurance include:

  • Part-time workers in communes, wards and townships, who concurrently enter into labor contracts, shall participate in social insurance under the subjects who sign labor contracts (Part-time workers in communes, wards and townships monthly pay 8% of the base salary to the pension and death fund. While those who enter into a labor contract pay monthly 8% of the salary rate paid for social insurance to the pension and death fund);
  • In case the employees who take leave due to their disease included in the List of diseases required long-term treatment:
    • The rate of entitlement to sick benefits for the incomplete month is up to the maximum of one month’s sickness benefits (currently, the maximum rate is not specified);
    • The female employees have pregnancies of twins or more, and a baby is dead when giving birth. The entitlement period of maternity allowance for childbirth and one-time allowance for childbirth are calculated according to the number of children born, including dead or live children (Currently, maternity benefits are only handled for live babies, pursuant to Clause 3, Article 10 of Circular 59/2015/TT-BLDTBXH).
