Procedures for applying for a certificate of business registration for study abroad consulting services

1. Scope of study abroad consulting services 

Study abroad consulting services include: 

• Introduce and advise on information about education policies of countries and territories; advise on choosing schools, courses, professions and qualifications suitable to learners’ abilities and aspirations; 

• Organize advertisements, conferences, seminars, fairs and exhibitions on studying abroad in accordance with the provisions of law; 

• Organize student recruitment and study abroad enrollment; 

• Organize training in necessary skills for Vietnamese citizens studying abroad; 

• Organize sending Vietnamese citizens to study abroad, take parents or guardians to visit training places abroad according to the provisions of law; 

• Other activities related to study abroad consulting services business.

2. Conditions for applying for a certificate of business registration for study abroad consulting services

Pursuant to Article 116, Decree 125/2024/ND-CP, an organization is granted a certificate of registration for business in study abroad consulting services when meeting the following conditions: 

• Have a stable operating headquarters, facilities and equipment to organize study abroad consulting activities; documents introducing and consulting information on education policies of countries and territories; documents consulting information on schools, courses, professions and training levels. 

• There is a team of direct study abroad consultants who meet the following requirements:

a) Have a university degree or higher; have the ability to use at least one foreign language at level 4 or higher according to the 6-level foreign language proficiency framework for Vietnam and equivalent;

b) Have a certificate of training in study abroad consulting as prescribed.

3. Application for a certificate of business registration for study abroad consulting services

To apply for a certificate of business registration for study abroad consulting services, the company needs to prepare a set of documents including: 

• Document requesting a certificate of business registration for study abroad consultancy services; with the main contents including: Objectives, content of activities; ability to exploit and develop study abroad services; plan and measures for implementation; solution when encountering risks for people being consulted for studying abroad.

• Copy of Business Registration Certificate. 

• The list of staff directly consulting on studying abroad includes the following main information: Full name, date of birth, gender, professional qualifications, foreign language proficiency, job position to be held at the study abroad consulting service organization; a copy issued from the original, a certified copy from the original or a copy with the original for comparison of university graduation diploma, foreign language certificate, and certificate of training in study abroad consulting. 

4. Procedures for granting a certificate of business registration for study abroad consulting services

Step 1: Prepare and submit application 

• Prepare 01 set of documents to apply for a Certificate of Business Registration for study abroad consulting services. 

• The company sends 01 set of documents as above via the online public service portal or by post or directly to the Department of Education and Training where the study abroad consulting service business is carried out. 

Step 2: Receiving and evaluating documents 

• Within 15 days from the date of receiving a complete and valid dossier, the Department of Education and Training shall organize an appraisal and prepare an appraisal report to assess the situation of meeting the conditions for conducting business in study abroad consulting services as prescribed in Article 116 of Decree 125/2024/ND-CP . 

Step 3: Granting a certificate of registration for study abroad consulting services 

• Within 05 working days from the date of the appraisal report, if qualified, the Director of the Department of Education and Training shall issue a certificate of business registration for study abroad consultancy services; if not qualified, the organization requesting the certificate of business registration for study abroad consultancy services shall be notified in writing and the reasons shall be clearly stated. 

• Certificate of registration of business in study abroad consulting services (according to Form No. 09, Appendix IV attached to Decree 125/2024/ND-CP ) is publicly announced in the mass media.
