Circular 08/2024/TT-BTTTT on elaborating regulations on telecommunications wholesaling

Circular 08/2024/TT-BTTTT provides a legal framework for wholesale telecommunications activities with a focus on fair pricing, transparent disclosure of technical/service information, and network safety compliance. It includes a standardized wholesale agreement template and aims to foster fair competition and protect stakeholders’ rights. 

Fair and Transparent Pricing 

• Wholesale services must be provided at reasonable, non-discriminatory prices, including equal treatment between internal divisions, subsidiaries, and external wholesale customers. 

• Providers must declare and publicly list prices in accordance with laws on pricing. 

Disclosure of Technical and Commercial Information 

• Wholesale providers must publicly disclose information on technical standards, service quality, network specifications, procedures, and conditions. 

• They must also provide a model wholesale agreement including: technical description, service quality standards, payment terms, dispute resolution mechanisms, confidentiality obligations, etc. 

• Providers may submit written requests for further guidance from the Ministry (Department of Telecommunications). 

Operational and Technical Compliance 

• Wholesale customers must comply with operational and technical requirements to ensure network safety and integrity. 

• Agreements must specify connection methods, service change/termination conditions, infrastructure safety, and cybersecurity obligations.
