Business conditions of automobile driver training facilities

Effective from January 1, 2025, Decree No. 160/2024/ND-CP officially comes into force, bringing significant changes to the conditions for registering automotive driving training services. 

1. Conditions for form of establishing a training facility 

According to Article 2 Decree No. 160/2024/ND-CP, driving training centers may be established under the following legal forms: Enterprises, Cooperatives, or Educational Institutions. 

2. Conditions for Human Resources  

The driving training institution’s personnel must be fully organized and meet professional requirements, a training facility shall have: Head of the training facility; Specialized departments or units; Subject departments; Support units for training. 

2.1. Conditions for the Head of the training facility (Article 7 Decree No. 160/2024/ND-CP) 

• The head of the driver training facility is the principal or director who is the legal representative and responsible for managing the activities of the training facility. 

• He/she holds a college degree or higher. 

• He/she has completed training and professional development in vocational education management. 

2.2. Conditions for instructors (Article 8 Decree No. 160/2024/ND-CP) 

a. Conditions for a theoretical instructor 

• He/she holds a Level 4 of VQF Diploma in one of the fields of law, automotive technology, automotive engineering, automotive assembly, or other fields where the training content of law or automotive studies constitutes 30% or more. Instructors for driving techniques must hold a corresponding driver license. 

• He/she holds one of the following pedagogical certificates: bachelor’s degree in teacher training, pedagogy, technical pedagogy; Level 4 of VQF diploma in pedagogy; pedagogical certificate for teachers at college and intermediate levels. 

b. Conditions for a practical driving instructor 

• He/she holds a Level 4 of VQF diploma or higher. 

• He/she possess a valid driving license for the vehicle category being taught or a higher category. 

• Instructors for categories B and C1 must have held their driver license for at least 3 years from the date of issue; instructors for categories C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE must have held their driving license for at least 5 years from the date of issues. 

• He/she holds one of the following pedagogical certificates: bachelor’s degree in teacher training, pedagogy, technical pedagogy; Level 4 of VQF diploma in pedagogy; pedagogical certificate for teachers at college and intermediate levels. 

•  He/she has completed training in practical driving instruction according to the program framework specified in Appendix II of Decree No. 160/2024/ND-CP. 

3. Conditions for Facilities and Equipment (Article 9 of Decree No. 160/2024/ND-CP) 

The training center must meet the following conditions regarding location, classrooms, training vehicles, and driving ranges: 

• The facility must be legally registered and have a minimum usable area of 1,000 m². 

• Classrooms used for theoretical and automotive technology instruction must comply with the standards set forth in Clause 2, Article 9 of Decree No. 160/2024/ND-CP. 

• Training vehicles must meet legal and technical standards and be suitable for the training objectives and target group, as specified in Clause 3, Article 9 of Decree No. 160/2024/ND-CP. 

• The driving range must comply with the legal requirements regarding land use, size, infrastructure, and equipment to ensure proper training conditions, as stipulated in Clause 3, Article 9 of Decree No. 160/2024/ND-CP.
