Law on Product and Goods Quality 2007 (Law No. 05/2007/QH12), adopted by the National Assembly on November 21, 2007 and effective from July 1, 2008:
a. Ensuring Product and Goods Quality
Organizations and individuals engaged in production and trading must:
- Ensure conformity with applicable technical regulations and declared standards;
- Declare conformity with standards or technical regulations (mandatory where applicable);
- Provide accurate labeling and necessary warnings.
b. Conformity Assessment, Certification, and Declaration
- Assessment activities are carried out by designated or accredited conformity assessment bodies;
- Certification of conformity may be performed by domestic or foreign organizations recognized by competent authorities.
c. Inspection and Supervision
State authorities have the right to:
- Inspect the quality of circulating products and goods;
- Inspect certification, declaration, and verification activities;
- Impose remedial measures if nonconformity is found.
d. Quality Management in Different Stages
Quality management is applied in three stages:
- Before market placement
- During market circulation
- Post-sale/use by consumers
The State applies appropriate management mechanisms at each stage (e.g., pre-market checks, post-market surveillance, traceability).
