Law on Architecture 2019

1. Scope and Applicable Entities

This Law governs architectural management and practice, and applies to all entities engaged in architectural activities within the territory of Vietnam.

2. Principles of Architectural Activities

• Must comply with laws and ensure harmony between national, community, and individual interests.

• Encourage the application of advanced science and technology, ensuring economic efficiency, aesthetics, technical effectiveness, and energy saving.

3. Preservation of National Cultural Identity in Architecture

• Provincial-level People’s Committees are responsible for organizing research and defining cultural identity requirements in local architectural management regulations.

• All individuals and organizations are responsible for preserving and promoting cultural identity in architectural works.

4. State Policies on Architecture

• The State invests in protecting and restoring valuable architectural works, expanding international cooperation, and promoting architecture through exhibitions and media.

• Encourages private investment in architectural research, technology transfer, and technical services in architecture.

5. Architectural Practice

• Individuals must obtain an architectural practice certificate (except in certain cases under Article 31 of the Law).

• Organizations must meet establishment and personnel conditions and notify competent authorities.

• The Law provides rules for the examination, issuance, renewal, and revocation of certificates. The certificate is valid for 10 years and nationwide.

6. State Management of Architecture

• The Government exercises unified state management over architectural activities.

• The Ministry of Construction is the lead agency in assisting the Government.

• Local People’s Committees are responsible for architectural management within their jurisdictions.
