Decree No. 46/2017/NĐ-CP on investment and operational conditions in the field of Education

1. Conditions for Establishment and Operation of Educational Institutions

a. Preschool Institutions 

• Must be legally established or authorized. 

• Minimum land area: 12 m²/child in rural and midland areas; 8 m²/child in urban and highland areas. 

• Must include eating areas, activity rooms, classrooms, playgrounds, and administrative offices. 

b. General Education Institutions 

• Must be legally established. 

• Minimum land area: 10 m²/student in rural/mountainous areas; 6 m²/student in urban areas. 

• Required facilities include: gender-separated restrooms, health room, library, and playground occupying at least 25% of the total area. 

c. Higher Education Institutions 

• Must be legally established. 

• Adequate physical infrastructure and teaching staff. 

• Valid curricula and teaching materials. 

2. Conditions for Operating Overseas Study Consulting Services

• Must be legally registered as a business entity. 

• Have adequate facilities and equipment to support operations. 

• Advisors must have at least a university degree, Level 4+ foreign language proficiency, and a professional certificate in study abroad consulting. 

3. Grounds for Suspension or Dissolution of Educational Institutions

An educational institution may be suspended or dissolved in the following cases: 

• Obtained permission through fraudulent means. 

• Fails to maintain required operating conditions. 

• Fails to begin educational operations within 1 year of receiving approval. 

• Commits violations subject to administrative penalties requiring suspension. 

• Its educational objectives or activities are no longer aligned with socio-economic development needs. 

• Voluntary request from the founding entity or individual. 

The authority to suspend or dissolve lies with the corresponding educational management bodies.
