Decree No. 16/2022/ND-CP, dated January 28, 2022, issued by the Government, stipulates administrative penalties for violations in the construction sector, fully replacing Decree No. 139/2017/ND-CP. This Decree sets out specific fines and remedial measures for violations in areas such as construction planning, construction permits, construction execution, quality management of construction works, and real estate and housing business activities. Notably, the maximum fine for organizations can reach up to VND 1 billion. The Decree introduces stricter regulations, including mandatory demolition of constructions built without or against permits, thereby eliminating the previous practice of imposing fines to legitimize unlawful constructions. It also clearly defines the responsibilities and sanctioning authority of relevant agencies, and provides that the fine for individuals is half of that imposed on organizations. The Decree took effect from the date of signing and applies to violations committed from January 28, 2022 onward.
