Decree No. 144/2020/ND-CP, dated December 14, 2020, issued by the Government, regulates activities in the performing arts sector, replacing Decree No. 79/2012/ND-CP and Decree No. 15/2016/ND-CP. This Decree governs the organization of art performances, beauty and model contests, and the distribution of audio and video recordings of performances in Vietnam.
Key highlights of the Decree include:
- Abolition of performance licensing: The requirement for licensing performances by domestic and foreign artists is removed, replaced by a notification mechanism to the relevant cultural authority prior to organizing the event.
- Simplified procedures for beauty and model contests: Organizers are now only required to submit prior notification instead of applying for permits for contests at the provincial level or higher.
- Stronger post-event supervision: Instead of pre-approval, regulatory agencies will conduct post-event inspections, holding individuals and organizations accountable for ensuring that performance content does not violate cultural, political, or ethical norms.
- Regulations on audio and video recordings: Production and distribution units are now responsible for self-review of content before releasing performing arts recordings; no pre-approval or licensing is required.
- Prohibited acts: The Decree clearly prohibits offensive acts such as wearing inappropriate costumes, making statements or gestures contrary to traditional morals, distorting history, or offending cultural icons and national heroes.
The Decree took effect on February 1, 2021, reflecting a shift toward deregulation and administrative simplification, while emphasizing the responsibility and accountability of individuals and organizations in the performing arts sector.
