Decree No. 119/2017/NĐ-CP, providing for administrative sanctions in the field of standards, measurement, and the quality of products and goods

Government Issues New Regulations on Sanctions in the Field of Standards and Product Quality 

On November 1, 2017, the Government promulgated Decree No. 119/2017/NĐ-CP providing for administrative sanctions in the field of standards, measurement, and the quality of products and goods. This Decree took effect on December 15, 2017, and replaces Decree No. 80/2013/NĐ-CP dated July 19, 2013. 

The new Decree introduces detailed regulations and stricter penalties for violations related to standards, technical regulations, and product quality. Notable highlights include: 

• A warning shall be imposed on any act of exploiting the National Quality Award to undermine the reputation of the award. 

• A fine ranging from VND 30,000,000 to VND 70,000,000 shall be imposed for transporting dangerous goods such as oxidizing substances, organic peroxides, or corrosive substances without the required permit. 

• A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed on the manufacture of motorcycle helmets without a valid Certificate of Eligibility for production or using an expired certificate. 

• A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed for producing or mixing gas or petroleum products without the required certificate, or using one that has expired.
