Government Issues New Regulations on Sanctions in the Field of Standards and Product Quality
On November 1, 2017, the Government promulgated Decree No. 119/2017/NĐ-CP providing for administrative sanctions in the field of standards, measurement, and the quality of products and goods. This Decree took effect on December 15, 2017, and replaces Decree No. 80/2013/NĐ-CP dated July 19, 2013.
The new Decree introduces detailed regulations and stricter penalties for violations related to standards, technical regulations, and product quality. Notable highlights include:
- A warning shall be imposed on any act of exploiting the National Quality Award to undermine the reputation of the award.
- A fine ranging from VND 30,000,000 to VND 70,000,000 shall be imposed for transporting dangerous goods such as oxidizing substances, organic peroxides, or corrosive substances without the required permit.
- A fine ranging from VND 30,000,000 to VND 40,000,000 shall be imposed on the manufacture of motorcycle helmets without a valid Certificate of Eligibility for production or using an expired certificate.
- A fine ranging from VND 40,000,000 to VND 60,000,000 shall be imposed for producing or mixing gas or petroleum products without the required certificate, or using one that has expired.
