Decree No. 102/2024/ND-CP, dated July 30, 2024, issued by the Government, provides guidance on the implementation of several provisions of the 2024 Land Law, focusing on land use planning, land allocation, land lease, land use purpose conversion, land recovery, and related administrative procedures. The Decree details the procedures for preparing and adjusting land use plans at all levels (national, provincial, and district), including assessing current land status, forecasting land use demand, and phasing the plans by period. It also allows for flexible mechanisms such as short-term land leasing (up to five years) for land development organizations, and transitional handling of procedures that were approved prior to August 1, 2024, but not yet completed. Regarding land recovery, the Decree specifies the applicable cases, procedures for compensation, support, and resettlement to protect the rights of affected individuals. Furthermore, it sets out provisions on continued land use after expiration of the land term, extension of land use duration, and handling of cases where land use exceeds prescribed limits. The Decree takes effect from August 1, 2024, and plays a key role in concretizing the implementation of the new Land Law in practice.
